Terms of service
General Terms and Conditions of BUNCA Coffee GmbH for consumers
Section 1 Scope and definitions
(1) These General Terms and Conditions apply, in the version valid at the time of the order, to all contracts concluded with us by consumers via our online shop at https://bunca.business.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code).
(3) Deviating terms of the customer do not become part of the contract unless we expressly agree to their validity in text form.
Section 2 Contracting party and conclusion of contract
(1) The contract is concluded with BUNCA Coffee GmbH, Kirchnerstraße 4, 60311 Frankfurt am Main, Germany, represented by the Managing Director Arsalan Ziegler.
(2) The presentation of goods in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order.
(3) The customer places the desired items in the shopping cart, opens the checkout process and enters their contact, delivery and billing details as well as the desired shipping and payment method. Registration is not required; ordering as a guest is also possible. Before submitting the order, the customer can review all details on the summary page and correct them using the browser's back function or the editing options in the checkout process.
(4) By clicking the "Buy now" button, the customer submits a binding offer to conclude a purchase contract.
(5) We confirm receipt of the order without undue delay by an automatically generated email. This acknowledgement of receipt does not yet constitute acceptance of the offer. The contract is concluded as soon as we declare acceptance separately or dispatch the goods and indicate this with a shipping confirmation.
(6) We store the text of the contract and send the customer the order details and these terms by email. The version applicable in each case can be accessed in the online shop at any time. Customers with a customer account can view their previous orders there.
Section 3 Prices, shipping costs, payment
(1) All prices are final prices and include statutory value added tax. Shipping costs as shown during the checkout process are added.
(2) For goods offered by weight, we additionally state the base price per kilogram.
(3) The payment methods displayed during the checkout process are available. These currently are credit card, PayPal, Klarna as well as Apple Pay and Google Pay. When paying via Klarna or PayPal, the terms of the respective provider apply in addition.
(4) The purchase price is due for payment upon conclusion of the contract, unless the selected payment method provides otherwise.
Section 4 Delivery, collection and delivery time
(1) We deliver within Germany and to the other member states of the European Union.
(2) Unless stated otherwise in the item description, we dispatch ordered goods within two working days of the conclusion of the contract. The carrier's delivery time is additional to this.
(3) Alternatively, the goods can be collected from one of our stores, provided this option is offered during the checkout process. We will notify the customer by email as soon as the order is ready for collection.
(4) In the case of delivery to consumers, the risk of accidental loss and accidental deterioration passes only upon handover of the goods to the customer.
Section 5 Retention of title
The delivered goods remain our property until payment has been made in full.
Section 6 Right of withdrawal
(1) Consumers have a statutory right of withdrawal. Details are set out in the Cancellation Policy.
(2) The right of withdrawal does not apply to contracts for the supply of goods which are liable to deteriorate or expire rapidly, nor to sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
(3) There is no right of withdrawal for contracts for services related to leisure activities for which a specific date or period is provided. This applies in particular to bookings of course dates in our Academy.
Section 7 Liability for defects
(1) The statutory provisions on liability for defects apply.
(2) We ask that obvious transport damage be reported to the delivery agent immediately and that you inform us. Failure by the customer to do so has no effect whatsoever on their statutory rights in respect of defects.
Section 8 Vouchers
(1) Promotional vouchers are issued free of charge as part of advertising campaigns, are valid only for the stated period and only in the online shop. One promotional voucher can be redeemed per order. Any remaining balance is neither refunded nor paid out. If goods paid for with a promotional voucher are returned under the right of withdrawal, we refund the amount actually paid.
(2) Gift vouchers can be purchased in the online shop and redeemed there. They can be redeemed until the end of the third year following the year of purchase. Balances are neither paid out in cash nor subject to interest. One gift voucher can be redeemed per order; purchasing further vouchers using a voucher is not possible.
Section 9 Applicable law and dispute resolution
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Section 10 Contract language
The contract language is German. This English version is provided for information purposes only; in the event of any discrepancy, the German version prevails.
